asked the Minister for Social Welfare the reason a person (details supplied) in County Wexford has not received disability benefit.

Payment of disability benefit to the person concerned was disallowed from 28 October 1987 following examination by a medical referee who expressed the opinion that she was capable of work. She was notified of the disallowance and of her right to appeal. She did not indicate to the Department that she wished to appeal this decision.

She submitted a further claim to disability benefit from 4 December 1987, with the same incapacity. Her claim was further disallowed by a deciding officer of the Department and she was notified of the disallowance on 20 January and of her right to appeal. No appeal has been received. She submitted medical evidence indicating she was fit to resume work on 20 January 1988.

asked the Minister for Social Welfare the reason a person (details supplied) in County Wexford is having £3 per week deducted from his disability benefit allowance.

The weekly deductions are to recover on over-payment of benefit which arose in respect of a dependent child who has reached the age of 18 years. In view of the particular circumstances of this case the deductions are being discontinued.
