asked the Minister for the Marine if he has received representations from the Irish Yachting Association regarding the proposed establishment of a mariculture industry in Oysterhaven Bay, County Cork; the effect this will have on water-based leisure activities; and if he will make a statement on the matter.

I have received the representations to which the Deputy refers.

The Fisheries Act, 1980, empowers me by Order to designate an area within which it is lawful to engage in aquaculture subject to licence. The first step in a process which may or may not lead to such a designation of Oysterhaven was taken towards the end of last year when a notice was published inviting representations or objections to the proposed designation. The Act provides that I can order a public inquiry — to be held locally — on foot of the response to the press notice to hear all sides in relation to designation prior to making an Order. I have not yet reached a decision on this case.

I would take this opportunity to point out that the designation of an area for aquaculture purposes does not mean that the area will be exclusively reserved for aquaculture. The fish farming industry must be developed in harmony with the interests of other water users including navigation, traditional fishing, amenity interests, sailing etc. The process laid down in the Fisheries Act, 1980, is designed to reconcile the needs of various water users and, where that is not possible, it enables me to decide where the balance of advantage lies. If Oysterhaven Bay is designated for aquaculture, the licensing of any aquaculture projects must take account of the requirements of other water users in the bay.
