Vol. 377 No. 9

Ceisteanna — Questions. Oral Answers. - Single European Act.

1.

asked the Taoiseach if he will report on the outcome of the Attorney General's examination of the constitutional implications of the Crotty judgment on the Single European Act for other international treaties.

The scope and application of the judgment in the Crotty case are at issue in proceedings currently pending before the High Court. In these circumstances it would not be appropriate, as yet, to arrive at final conclusions as to the implications of the judgment. As I have already indicated, I will be in touch with the leaders of the other political parties in the House, once the examination has been completed.

Am I to understand from the Taoiseach's reply that the Attorney General has not completed his report, or that he has not completed his report but that the Taoiseach wishes to keep it confidential at this stage?

A little of both. He has completed his own assessment in so far as it is within his capacity to do so, but the McGimpsey case is current and may affect the final outcome.

Can the Taoiseach at this stage rule out the possibility of the need for a second referendum arising out of the Single European Act?

It is a little early to come to any decision about that matter yet.
