asked the Minister for Social Welfare the reason for the delay in the payment of disability benefit to a person (details supplied) in County Louth.

Payment of disability benefit to the person concerned was disallowed from 9 January 1988 following examination by a medical reference who expressed the opinion that she was capable of work. To date, she has not indicated to the Department that she wishes to appeal the decision to disallow payment. If she wishes to pursue this matter further she should contact the Department immediately and her case will be reviewed.

The person concerned was in hospital from 17 February 1988 to 24 February 1988. Payment has been issued for this period.

asked the Minister for Social Welfare the reason a person (details supplied) in County Wexford was recently refused disability benefit.

The person concerned was paid disability benefit to 25 April 1987, after which date payment was disallowed following an examination by a medical referee who expressed the opinion that he was capable of work. He appealed against the disallowance and was again examined by a different medical referee on 10 June 1987 who also expressed the opinion that he was capable of work.

The case was referred to an appeals officer who decided that the appellant was not incapable of work within the meaning of the Social Welfare (Consolidation) Act 1981 in respect of the period from 27 April 1987 to 11 January 1988 and was not entitled to be paid in respect of that period. He appealed against the disallowance of disability benefit subsequent to the date of the appeals officer's decision and he will be examined today by a medical referee in connection with his appeal. The case will be reviewed in the light of the medical referee's report.
