asked the Minister for the Environment the control which exists on the movement of hazardous waste; if it is intended to establish a facility for dealing with these wastes; and if a location for such a facility has been identified.

Since 1 January 1983 all aspects of the disposal of toxic and dangerous waste have been subject to control under the European Communities (Toxic and Dangerous Waste) Regulations, 1982. The exercise of control functions under these regulations is a matter for the local authority in whose area the waste is located and any person storing, treating or depositing such a waste needs a permit from the local authority. The regulations introduced a consignment note procedure for both domestic and export waste movements. While domestic waste movements will continue to be subject to control under the 1982 Regulations, a new control regime for export and import movements is provided for in the European Communities (Transfrontier Shipment of Hazardous Wastes) Regulations, 1988, which come into operation on 1 November 1988. The regulations give effect to a group of EC Directives on inter-state movements of hazardous wastes.

With regard to hazardous waste disposal facilities in this country I would refer the Deputy to my announcement earlier this year of a scheme of capital grant assistance to encourage the waste disposal sector to provide an appropriate range of treatment and disposal facilities in this country. I am not in a position as yet to indicate what facilities are likely to be provided under the scheme or where they will be located.
