asked the Minister for Energy the legislation or sections of legislation for which he is responsible which have been passed by the Houses of the Oireachtas and not yet brought into force; and the reason the legislation is not yet in force.

The position regarding legislation for which I have responsibility is as follows:

Section 9 of the Electricity (Supply) (Amendment) Act, 1988, repeals sections of previous Acts exempting ESB property from rates, and will become effective when I have made an appropriate order under the Act. This cannot be done until after the determination of the global valuation of ESB property by the Commissioner of Valuation as provided for under the Valuation Act, 1988.

Sections 9 to 38 of the Forestry Act, 1988 provide for the establishment of the State company (Coillte Teoranta) to undertake the functions of the Forest Service. These sections will be brought into force and the new company will be established as soon as the necessary arrangements are completed.
