asked the Minister for Industry and Commerce if his Department will investigate the operation of Dutch auctions (details supplied) in Dublin 1 as there have been numerous complaints that people are being cheated there; and if he will make a statement on the matter.

I have been advised by the Director of Consumer Affairs and Fair Trade that he has received a number of complaints in relation to this matter and has carried out an investigation into the operation concerned. So far he has been unable to acquire sufficient evidence to sustain a prosecution under the Consumer Information Act, 1978 (as amended).

I have asked the director to investigate whether there has been any breach of the Occasional Trading Act, 1979. I am also examining, in consultation with the director, whether new or amending legislation is necessary to deal with this type of problem. In the meantime, any information that the Deputy can provide which would assist the director in his investigations would be appreciated.
