asked the Minister for Justice if, in view of the judgement of the European Court of Human Rights limiting detention without charge to a maximum of four days, Ireland will enter a derogation to the European Convention of Human Rights and Fundamental Freedoms, or alternatively if he proposes to amend the Emergency Powers Act, 1976; and if he will make a statement on the matter.

The section of the Emergency Powers Act, 1976, which provides for the detention of persons without charge is not in force at present. Accordingly, the question of making a derogation from the European Convention on Human Rights in respect of that Act does not arise.
