asked the Minister for Labour if he will list the public service and public sector employment where leave of absence is provided by (a) statutory entitlement or (b) custom and practice; and if he will make a statement on the matter.

The Deputy's question relates to a variety of types of leave from public service and public sector employment. Statutory provisions exist in respect of annual holidays and maternity leave. Conditions of employment and collective agreements would also cover these types of leave situations as well as leave in a wide variety of specific circumstances (e.g. sick leave, study leave).

As regards leave for employees elected to the Houses of the Oireachtas, the legislation establishing most State-sponsored bodies makes specific provision for this type of leave. In other cases, it is provided by custom and practice, except for the Civil Service in which case the person concerned must resign on standing for election.
