Written Answers. - Social Welfare Benefit.

asked the Minister for Social Welfare if he will continue disability benefit payment to a person (details supplied) in County Waterford, in view of conflicting medical evidence.

The appeal of the person concerned has been referred to an appeals officer for determination and an oral hearing of his appeal is being held today. He will be notified of the appeals officer's decision in due course.

asked the Minister for Social Welfare the reason income from a farm is being assessed against a person (details supplied) in County Kerry when he does not own, occupy or receive income from a farm.

On 29 June, 1988 the person concerned transferred all his lands to his nephew under a deed of transfer.

The deed of transfer was investigated by a social welfare officer on 1 July, 1988. Inquiries indicated that the person concerned was still in beneficial occupation of the holding.

If the circumstances of the person concerned have changed since the last investigation, he should notify my Department and his claim will be re-investigated.

asked the Minister for Social Welfare when a person (details supplied) in County Cork will receive a medical referee's examination in connection with his appeal for disability benefit; and if he will have this medical referee's examination carried out in Skibbereen or Dunmanway to facilitate the applicant.

Payment of disability benefit to the person concerned was disallowed from 7 July 1989 following examination by a medical referee who expressed the opinion that he was capable of work.

He did not appeal against the decision to disallow his claim but continued to submit medical certificates to the Department. A further medical examination has now been arranged and will be held in Skibbereen on 23 November 1989. His entitlement to benefit from a current date will be reviewed in the light of this result.

asked the Minister for Social Welfare if he will grant a fuel allowance on appeal to a person (details supplied) in County Cork.

The national fuel scheme applies to persons in receipt of long-term social welfare or health board payments. The person concerned is in receipt of disability benefit since 21 September 1989. This is not a qualifying payment for the purposes of the national fuel scheme and he is not, therefore, entitled to a fuel allowance under that scheme. He was notified accordingly on 16 October 1989.

If the person concerned has a special need for extra heating arising from a medical condition then he could apply to the local health board for a heating allowance on these grounds.
