Mr. Kitt

asked the Minister for Social Welfare the reason unemployment benefit has not been paid to a person (details supplied) in County Galway.

An applicant for unemployment benefit who is a landholder and does not satisfy the contribution conditions of having 78 paid contributions in the preceding three year period, is not entitled to unemployment benefit if the daily income from his holding exceeds £4.00.

The person concerned is a land holder who does not have the required 78 paid contributions in a three year period and whose profit from his holding exceeds £4.00 daily. Accordingly, his application for unemployment benefit made on 17 August 1989 was disallowed.

He has appealed against this decision and arrangements are being made to have his appeal heard at the earliest opportunity. He is currently in receipt of unemployment assistance at the weekly rate of £27.90 being the maximum rate of £57.00 payable to a claimant with four children whose spouse is not an adult dependant, less means of £47.00, derived from land and spouse's income, plus an equal treatment alleviation payment of £17.90. He has also appealed the means assessment and his file is with the Social Welfare Officer for investigation. On completion of the investigation his case will be submitted to an Appeals Officer for determination without delay.
