Question:

127 Mr. McCartan asked the Minister for Justice the number of occasions in the past 20 years upon which the provisions of Article 15.13 of the Constitution (a) were relied upon as a defence in criminal proceedings, (b) were deferred to as a reason for not instituting proceedings and (c) led to proceedings being withdrawn by the Director of Public Prosecutions.

The Garda authorities have informed me that information is not available from Garda records relating to the number of cases in which the privilege from arrest conferred by Article 15.13 of the Constitution was invoked.
