45 Mr. Byrne asked the Minister for the Environment if he has received representations from Dublin City Council regarding the operation of the ultra vires ruling in local government; if he will outline his response to the representations if any change is planned in the ultra vires rules; and if he will make a statement on the matter.

46 Mr. Ryan asked the Minister for the Environment , in the context of his consideration of local government reform, his intentions with regard to the proposals set out by the former Minister for Local Government, currently the Minister for Energy, which inter alia recommended the abolition of all town commissions and urban district councils; and if he will make a statement on the matter.

58 Mr. Quinn asked the Minister for the Environment if he will make available, on an interim basis, his present position in relation to local government reform and restructuring, excluding financial provisions, so as to enable a substantial debate to take place having regard to the enormous amount of work that was done by his predecessors and which was partially completed in 1985 in respect of the restructuring of the territory and operation of local government authorities around the country; and if he will make a statement on the matter.

60 Mr. Sherlock asked the Minister for the Environment , in relation to the Government announcement of 5 April 1990 that the local elections will be postponed until June 1991, if he will outline the terms of reference of the Cabinet subcommittee to review legislation governing the functions and structures of local government; if it is intended to bring the terms of reference before Dáil Éireann for approval; the membership of the Cabinet subcommittee; the high level experts who will advise the Cabinet subcommittee; if any deadline has been set for the completion of the work of the subcommittee; and if he will make a statement on the matter.

77 Mr. Quinn asked the Minister for the Environment if his attention has been drawn to the fact that the General Council of County Councils made a submission on local government reform to the Minister for the Environment in August 1984, and updated that submission in 1988 which was also presented to the Minister for the Environment; the additional submissions, if any, he requires from the General Council of County Councils in order to enable him to publish his proposals for local government reform; and if he will make a statement on the matter.

82 Mr. Shatter asked the Minister for the Environment the names of the seven experts being appointed by the Government to assist the Government in formulating proposals for the reform of local Government.

I propose to take Questions Nos. 45, 46, 58, 60, 77 and 82 together.

As Deputies are aware, a statement issued by the Government Information Service on 5 April, a copy of which has been placed in the Oireachtas Library, outlined the Government's intentions in regard to local government reorganisation.

Given the extent of studies by previous Governments and proposals by various bodies, it is considered that the production of still further papers on the question would at this stage be counter-productive. The Government therefore have appointed a special Government committee for the purpose of making recommendations on the structures and functions of local government, on the basis set out in the statement dated 5 April. The Government committee is chaired by the Minister for the Environment and includes the Ministers for Energy, Foreign Affairs, Health and Justice and Minister of State Deputy Harney; it has been asked to report by 30 September 1990. A committee of experts is in the process of being established to assist in this task. Related matters such as the question of local government at the sub-county level and changes in theultra vires doctrine are being considered in the context of the overall reform proposals.
