Written Answers. - Instruction to Peace Commissioners.

Question:

126 Mr. J. O'Keeffe asked the Minister for Justice the steps which have been taken to inform peace commissioners of (1) the High Court decision of 6 July 1989 that their statutory power to decide whether to grant bail is unconstitutional and (2) the recent Supreme Court decision on the invalidity of search warrants issued by peace commissioners based on the suspicion of the requesting Garda officer.

The initiative in seeking remands in custody or on bail, or in seeking search warrants, rests with the gardaí who are aware of the decisions referred to in the question. In the circumstances there is not considered to be any need to issue any formal instruction to peace commissioners on these matters.
