Question:

396 Mr. Byrne asked the Minister for the Environment whether the stipulation in section 5 (1) of the Road Traffic (Construction Equipment and Use of Vehicles) (Amendment) Regulations 1985 (details supplied) applies retrospectively to such vehicles in use before the making of these regulations; and if not, whether the regulations only apply to new vehicles after 1 January 1986.

The regulations referred to require heavy goods vehicles, semi-trai-lers and trailers first licensed on or after 1 January 1986 to be equipped with side-guards. They are deemed to apply to both new and imported used heavy commercial vehicles first licensed on or after that date.
