Question:

131 Mr. McCartan asked the Minister for Justice the number of cases which have been dealt with arising from deliberation of an Authority, if any, established pursuant to Article 17 of the European Communities (Aliens) Regulations, 1977; the number of these which have been (1) upheld and (2) varied by him in each of the past five years; and if he will make a statement on the matter.

132 Mr. McCartan asked the Minister for Justice if he will outline the Government's response to date to the establishment of an Authority, as envisaged by Article 17 of the European Communities (Aliens) Regulations, 1977; whether such an Authority has been established; if so the number of applications which it has been requested to deal with in each of the past five years; if an Authority has not been so established the reason this has not been done; if it is proposed to have any established; if so, when and the persons who will be appointed to each such Authority; if he will outline the further assistance which will be available for persons seeking recourse to the authority; and if he will make a statement on the matter.

I propose to take Questions Nos. 131 and 132 together.

The Authority provided for by Article 17 of the European Communities (Aliens) Regulations, 1977 has been established. The person appointed to be the Authority is a judge of the Circuit Court. Since 1 July 1986 two cases have been referred to the Authority. In both cases the view of the Authority supported the decision that had been taken.

Question:

133 Mr. McCartan asked the Minister for Justice the number of persons prosecuted and/or convicted in each of the past five years for offences contrary to Article 18 of the European Communities (Aliens) Regulations, 1977; and if he will make a statement on the matter.

There have been no prosecutions or convictions in the past five years in respect of offences contrary to Article 18 of the European Communities (Aliens) Regulations, 1977.

Question:

134 Mr. McCartan asked the Minister for Justice the number of persons required to leave the State, by order made pursuant to the Article 14 of the European Communities (Aliens) Regulations, 1977; and if he will make a statement on the matter.

No person was required to leave the State pursuant to Article 14 of the European Communities (Aliens) Regulations, 1977.

135 Mr. McCartan asked the Minister for Justice the number of persons who had a residence permit withdrawn in each of the past five years under Article 9 of the European Communities (Aliens) Regulations, 1977; the reason proffered for such decisions in each case and in general; and if he will make a statement on the matter.

No residence permits issued under the European Community (Aliens) Regulations, 1977 have been withdrawn during the past five years.

136 Mr. McCartan asked the Minister for Justice the number of persons who have applied for a residency permit under Article 5 of the European Communities (Aliens) Regulations, 1977, in each of the past five years; the number which have been (1) granted and (2) refused; the nationality and/or country or origin of each applicant; and if he will outline the reason(s) which were proferred for refusal in each case and in general.
