Question:

67 Mr. J. Bruton, Mr. J. Mitchell, Miss Flaherty, Mr. Connor and Mr. Carey asked the Minister for Finance if he will give details of each licence granted to allow exploration of historic wrecks in areas restricted under section 5.3 of the National Monuments Act, 1987.

The details of licences granted under Section 3 (5) of the National Monuments (Amendment) Act 1987, to dive at historic wrecks are given in the list which is being circulated in the official report.

Question:

68 Mr. J. Bruton, Mr. J. Mitchell, Miss Flaherty, Mr. Connor and Mr. Carey asked the Minister for Finance if he will consider amending the National Monuments Act, 1987 to confer protection on historic wrecks that are less than 100 years old.

It is not considered necessary to introduce "blanket" protection for such wrecks. Current legislation provides measures to protect any particular wreck on account of its historical, archaeological or artistic importance.

69 Mr. J. Bruton, Mr. J. Mitchell, Miss Flaherty, Mr. Connor and Mr. Carey asked the Minister for Finance the number of consents to the use of metal detectors at archaeological sites granted by the Commissioners for Public Works under section 52 (2) of the National Monuments Act, 1987.

The Commissioners of Public Works have granted ten consents for the use of metal detection devices at archaeological sites, under Section 2 (2) of the National Monuments Act 1987.

70 Mr. J. Bruton, Mr. J. Mitchell, Miss Flaherty, Mr. Connor and Mr. Carey asked the Minister for Finance if he will give details of each underwater heritage order made under section 5.3 of the National Monuments Act, 1987 to restrict interference in specified areas with historic wrecks.

The provisions of section 3 of the National Monuments (Amendment) Act 1987 have to-date proved adequate to protect historic wreck sites, without recourse to the need to invoke the particular provisions relating to underwater heritage orders. One underwater heritage order was made, however, to protect crannóg sites at Lough Donogher, County Leitrim.

71 Mr. J. Bruton, Mr. J. Mitchell, Miss Flaherty, Mr. Connor and Mr. Carey asked the Minister for Finance the number of prosecutions for the use of metal detectors taken to date under section 5.2 of the National Monuments Act, 1987.

There have been five prosecutions under section 2 of the National Monuments (Amendment) Act, 1987 arising from the use of metal detectors.

72 Mr. J. Bruton, Mr. J. Mitchell, Miss Flaherty, Mr. Connor and Mr. Carey asked the Minister for Finance if he will give a list of archaeological areas designated by him for the purpose of section 5.2 of the National Monuments Act, 1987, which bans the use of metal detectors therein.

One archaeological area has been designated under section 5 of the National Monuments (Amendment) Act, 1987; namely Tooles Moat, Oldconnaught, County Dublin. It must be emphasised, however, that it is an offence under this Act to use, or to be in possession of a metal detector, for the purpose of searching for archaeological objects, whether or not a site has been registered as an archaeological area or historic monument site.
