Question:

50 Mr. M. Higgins asked the Minister for Education if he will consider amending Rule 46 of the Rules and Regulations for Secondary Schools, having regard to the enormous problems it poses by excluding the children of returned emigrants from the position whereby they can substitute for Irish another approved subject under Rule 21 (1) (a) and (b), and who are still obliged to resume their studies in Irish and compete with their fellow students as if they never left these shores, thereby putting them at an immense disadvantage if they fail their leaving certificate Irish, by disqualifying them from a place in the colleges of the NUI, Garda Síochána, cadets, nursing and teaching; and if he will make a statement on the matter.

In general, I would not be inclined to accept that the rule cited by the Deputy poses enormous problems for children of returned emigrants.

However, there is some evidence that it can make for difficulties in certain instances and I am arranging to have the matter examined to see whether they can be overcome.
