I am satisfied that there are adequate powers available to deal with malpractices of the kind referred to by the Deputy. A person who makes telephone calls of an offensive, indecent, obscene or menacing character or who persistently makes calls without reasonable cause or for the purpose of causing annoyance, inconvenience or needless anxiety can be prosecuted in the courts and, if convicted, shall be liable to a fine of up to £50,000 or to imprisonment for up to five years or to both the fine and imprisonment. Telecom Éireann also have the power to suspend service to any subscriber who uses the phone for making obscene or menacing calls. I would point out, of course, that Telecom Éireann are merely assisting the appropriate law enforcement authorities and are not primarily responsible for handling such cases.
