Vol. 418 No. 5

Request to Move Adjournment of Dáil under Standing Order 30.

The reason I am bringing this matter forward is the indefinite nature of the decision made by the High Court yesterday in relation to United Meat Packers. I request leave to move the Adjournment of the Dáil under Standing Order 30 to discuss the failure of the Companies (Amendment) Act, 1990, which allows for the appointment of an examiner by the High Court to run a company which has encountered financial difficulties and the necessity to further amend the Act so that the examiner can carry out his functions as was intended when the 1990 Act was passed by the Oireachtas. It is clear from yesterday's decision——

The Deputy is deviating from the notice he submitted to me. This is not in order.

——that the High Court cannot control the receiver's actions. We urgently need to amend the legislation.

Deputy Deasy, this is not good enough.

Will the Taoiseach respond?

Having considered the matter fully I do not consider it to be one contemplated by Standing Order 30 and I therefore cannot grant leave to move the motion.

So much for passing legislation in the House.

I would like a response from the Taoiseach.

This is not in order now, Deputy.
