81 Mr. Flanagan asked the Minister for Justice if he intends introducing a criminal offence of fraud; and if he will make a statement on the matter.

82 Mr. Flanagan asked the Minister for Justice if he will outline the steps he proposes to take to amend the law on fraud and dishonesty; when he expects the publication of a review in this area of law, currently being prepared by the Law Reform Commission; and if he will make a statement on the matter.

I propose to take Questions Nos. 81 and 82 together.

The question of changes in the criminal law in the area of fraud and dishonesty will be considered when the report of the Law Reform Commission on the general law of dishonesty is received by the Attorney General and submitted to the Government. I understand that the Commission's report on the matter is at an advanced stage of preparation.

In view of the terms of the first question, I should make it clear that, while there is at present no specific offence of fraud as such in our criminal law, there are, of course, existing criminal offences which penalise fraudulent behaviour. I make that comment purely for the purpose of clarification and without in any way wishing to prejudge issues regarding the need for reform of the law in this area.
