Question:

198 Mr. Cox asked the Minister for Arts, Culture and the Gaeltacht the position regarding the insurance on people crossing lands to visit national monuments; and if he will make a statement on the matter.

I assume that the Deputy's question relates to national monuments which are either privately-owned, or can be visited only by crossing private property. I understand that the liability for accidents occurring on private property is primarily a matter between the injured party, the landowner, and the landowner's insurance company—where a relevant policy exists. I understand also that some landowners have closed off public access to national monuments on their lands because of the danger of accident claims. The closures are taking place on the advice of solicitors and insurance companies who are unhappy with the current law on occupier's liability.

The Law Reform Commission is examining the occupier's liability issue at present and I understand that a White Paper will be published subsequent to the commission's report. I hope to be in a position to give a further response at that stage.
