Question:

15 Mrs. Doyle asked the Minister for the Environment the reason S.I. 25/1990 was amended in July 1992 by S.I. 209/1992.

The Local Government (Planning and Development) Regulations, 1992 (S.I. No. 209 of 1992) amended the Local Government (Planning and Development) Regulations, 1990 (S.I. No. 25 of 1990) as regards environmental impact assessment for projects, other than road works, which a local authority proposes to undertake outside its functional area. Such projects require planning permission and the changes introduced by the 1992 Regulations require them to undergo EIA through the planning process in the same way as private development.
