Written Answers. - Ownership of Family Home.

Question:

270 Mr. G. Mitchell asked the Minister for Equality and Law Reform if his announcement that legislation will be brought before Dáil Éireann this summer giving stay-at-home mothers a financial share in the family home will include women, such as a person (details supplied) in Dublin 12 who has been separated for 16 years and whose husband has his own local authority flat but who is still registered as a joint purchaser of her own local authority house; and if he will make a statement on the matter.

The legislation which is to be introduced is designed to give each spouse equal rights of ownership in the family home and contents. From the details supplied, it would appear that the particular property is already jointly owned and that, therefore, the proposed legislation would not be relevant in this instance.
