Question:

153 Mr. Gilmore asked the Minister for the Environment if his attention has been drawn to the fact that An Bord Pleanála has no power to alter a planning decision where an error of fact has been made; and if he will amend this legislation to enable An Bord Pleanála to correct decisions in these cases.

Decisions of An Bord Pleanála are made by way of sealed orders. The board has no power to alter an order after it is made. The validity of any particular order is a matter for the courts to decide. I have no proposals to amend the law in this regard.
