Question:

58 Mr. Callely asked the Minister for Justice the policy she has in relation to questioning a suspect by Garda between the hours of 12 midnight and 8.00 a.m.; if she has received any feedback from the Garda on this policy; and if she will make a statement on the matter.

The procedures to be followed by the Garda Síochána in relation to the questioning, between the hours of midnight and 8 a.m. of arrested persons suspected of committing criminal offences are contained in the Criminal Justice Act, 1984 (Treatment of Persons in Custody in Garda Stations) Regulations, 1987. These regulations are kept under review, and if any amendments in the law in relation to this matter are considered necessary, they will be announced in the usual way.
