Question:

23 Mr. Sargent asked the Minister for Finance when the EC Bird Directive is to be transposed into Irish law; and the way in which this will affect the future of the landfill facility at Rogerstown Estuary.

E.C. Directive No. 79/409, known as the Bird Directive, has been transposed into Irish law by the European Communities (Wildlife Act, 1976) (Amendment) Regulations, 1986 (S.I. No. 254 of 1986).

Part of the Rogerstown Estuary, which is of international importance for Brent Geese, has been declared a Special Protection Area for birds in accordance with Article 4 of the Directive. The landfill facility at Rogerstown Estuary is outside the Special Protection Area for birds and was already in use prior to the designation of the site.
