Question:

68 Mr. Gregory asked the Minister for Justice the number of documents withheld from the national archives by her Department since the National Archives Act; the reason documents were withheld; and if she will make a statement on the matter.

The task of compiling the information requested by the Deputy would involve detailed research and examination of departmental records and the benefits accruing would not justify the effort and commitment required.

Any files or documents which were not transferred to the national archives would have been retained in accordance with the appropriate certificates made under section 8 of the National Archives Act, 1986, and the National Archives Act, 1986, Regulations 1988. For example, in accordance with an order made under section 8 (11) of the Act, personnel and pension case files and related records concerning individual civil and public servants are withheld.
