Question:

18 Mr. Sargent asked the Minister for Transport, Energy and Communications the validity of a purchased travel voucher in a travel agent's liquidation in view of the fact that the customer paid money and received the equivalent of a ticket in monetary terms and should therefore be entitled to be deemed within the bonded insurance indemnity provided to all travel ticket holders.

The administration of the bond of a failed travel agent is governed by the provisions of the Transport (Tour Operators and Travel Agents) Act, 1982 and Regulations made under that Act. The question of travel vouchers is covered under Regulation 15 of the Transport (Tour Operators and Travel Agents) Act, 1982 (Claims by Customers) Regulations, 1983 (S.I. No. 104 of 1983) which states that:

Where a customer of a tour operator or travel agent holds a voucher, trading stamp or similar token furnished to him by the tour operator or travel agent, being a voucher, trading stamp or similar token which is exchangeable as payment or part payment for services provided or to be provided by the tour operator or travel agent, but which has not been so exchanged, no reimbursement shall fall due to that customer in respect of any sum represented by that voucher, trading stamp or similar token.

This means that customers of a failed travel agent who have received vouchers which have not been exchanged for a specific holiday booking are not entitled to a refund for the value of the voucher. Similarly, purchasers of such vouchers are not entitled to a refund under the bond.
