Written Answers. - Right to Remain Silent.

Question:

60 Ms O'Donnell asked the Minister for Justice her views on the recent recommendation by a retired judge that the right of people to remain silent when they are being questioned by the Garda should be abolished.

I am aware of the remarks made by the former judge regarding the right of persons to refuse to answer questions put to them by the Garda Síochána.

As the Deputy will be aware, a number of statutory provisions require persons to provide information to the Garda Síochána in relation to particular offences. I am keeping the matter under review and any proposals I may have to change the law in this area will be announced in the usual way.
