52 Dr. Upton asked the asked the Tánaiste and Minister for Foreign Affairs, in respect of claims for negligence and nuisance against his Department for each year since 1990, the total number of claims made; the total number of claims settled; the total amount of money paid in settlements; the total amount of money paid in legal costs arising from the settlements; the total number of claims outstanding at present; and the estimated cost of these claims. [

The total number of claims for negligence and nuisance against the Department of Foreign Affairs since 1990 is 35. Of these claims, 28 have been settled and a total of £81,965 was paid in settlements. The amount paid in legal fees was £14,274; the legal fees payable in respect of one of the cases settled in 1994 still remain to be established.

There are 7 claims outstanding against the Department at present; however it is not feasible to provide an estimate of the cost of these claims.

There have been no claims for negligence and nuisance against the Office of the Tánaiste since its establishment.
