Question:

62 Miss Coughlan asked the Minister for Health if it is the function of local authorities to inspect canteen and hygiene facilities at marts; if new regulations are being introduced with regard to standards for mart canteens; and if he will make a statement on the matter. [1947/95]

The inspection of premises engaged in the sale of food for public consumption is carried out by environmental health officers from the health boards under the Food Hygiene Regulations 1950-89.

The food hygiene regulations set out the statutory requirements in relation to food hygiene and food premises. They prohibit the sale for human consumption of food which is diseased, contaminated or otherwise unfit for human consumption. The regulations require that adequate precautions shall be taken to prevent the contamination of food intended for human consumption at all stages of its importation, manufacture and distribution. These include the maintenance of hygienic conditions in food premises and observance of certain hygienic precautions by food handlers. The regulations also provide for the seizure and destruction of unfit food. They also provide for the registration of certain categories of food premises and food stalls. In certain circumstances, the chief executive officer of a health board may apply to the district court for an order to close a food premises or stall.

Following consultation with the various interests involved, I will be introducing new food hygiene regulations later this year which will give national effect to the European Council Directive 93/43/EEC on the Hygiene of Foodstuffs. These new regulations will apply to food business in general and will set minimum standards for those engaged in the food retail business. It is not my intention to introduce regulations specifically for mart canteens.
