Question:

7 Miss Harney asked the Minister for Tourism and Trade the present status of the proceedings being taken by the Goodman Group against the State in respect of export credit insurance; when the case is likely to come to court; and if he will make a statement on the matter. [1158/95]

The pleadings in the proceedings referred to by the Deputy have not been closed. Consequently, notice for trial has not been served.

Proceedings were initiated in October, 1989. Can the Minister advance any reason for the length of time this case has taken?

The pleadings in the court case have not been finalised.

Why not? Can the Minister not give further information on the background to this delay?

I cannot speak for the plaintiffs and say why their pleadings have not been completed. Court dates have not been fixed.

Why not? Can the Minister say if this case is likely to become before the courts?

I do not know. Nothing has happened in the case since 1991. Pleadings have not been completed and, therefore, I cannot comment on when, if ever, the case might come to court.

Proceedings were initiated in 1989 yet the Minister tells us that nothing happened since 1991.

That is correct.
