Question:

139 Mr. E. Byrne asked the Minister for Justice the reason the prosecution failed to appear in Court resulting in the charges of supplying heroin being struck out against two persons (details supplied) who appeared before Judge Desmond Hogan sitting in the Dublin District Court on Monday 14 November 1994; and if she will make a statement on the matter. [5143/95]

I am informed by the Garda authorities that the prosecuting Garda did not appear in court on the day in question because he had incorrectly noted the date of the hearing. I am also informed that the file in the matter is currently with the Director of Public Prosecutions to see whether the charges can be reentered.
