Question:

46 Miss Coughlan asked the Minister for Finance if the European Community has made a decision regarding the legality of his Department's requirements requesting a tax clearance certificate for grant aid over £5,000 under the control of farmyard pollution scheme; and if he will make a statement on the matter. [6293/95]

The European Union has not raised any queries about tax clearance and the control of farmyard pollution scheme.

The Commission has raised the issue of tax clearance being applied to the payment of headage grants. This matter is under consideration at present.
