53 Mr. Bree asked the Minister for Health if disabled person's maintenance allowance payments made to people with no income pending actions in the court for personal injuries are recoverable. [6462/95]

Limerick East): Disabled person's maintenance allowance, DPMA, is payable under section 69 of the Health Act, 1970 and regulations made thereunder and not under the Social Welfare Acts. A person with no income who is medically eligible for disabled person's maintenance allowance would be entitled to this allowance pending actions in the court for a personal injuries claim. There is no provision under the current disabled person's maintenance allowance regulations for the recovery of disabled person's maintenance allowance following a personal injuries claim in the courts.
