It is not the normal practice to comment on the progress in individual Garda investigations and I do not propose to depart from that practice in this instance. I understand, however, that this investigation is at an advanced stage.

I have been informed by the Garda authorities that a report on the investigation of allegations made by the person concerned was forwarded to the Office of the Director of Public Prosecutions in 1989 and a decision not to institute proceedings was taken.
The Garda authorities have also informed me that following a further investigation in 1994, the file was again forwarded to the Office of the Director of Public Prosecutions and the decision as regards prosecution was not changed.
142 Miss Harney asked the Minister for Justice the progress, if any, that has been made in relation to the case involving a person (details supplied) in Dublin 22; and if she will make a statement on the matter. [10765/95]
I have been informed by the Garda authorities that their investigation report on allegations made by the person concerned was referred to the Office of the Director of Public Prosecutions where a decision was taken in 1992 and there should be no prosecution.
I understand, however, that further Garda inquiries are being made in this case and it is expected that, when these have been completed, a file will be resubmitted to the Director of Public Prosecutions in due course.
