279 Mr. N. Treacy asked the Minister for Enterprise and Employment the reason documentation which was committed in April 1994, has not been made available to a person (details supplied) in County Galway; if he will direct his Department to provide the relevant information; the date on which this will be done; and if he will make a statement on the matter. This issue involves lands at Choose, Whitegate, Co. Galway, ownership of which is registered in the name of the Minister for Industry and Commerce, since 1936. My predecessor, in his letter of 15 April, 1994 stated that a detailed investigation in relation to ownership would have to be made.

Inquiries have since been made with the Land Registry, with the Land Commision, with the Chief State Solicitor's Office and with the Valuation Office. It has now been established that these lands were acquired for the ESB, in connection with the Ardnacrusha Hydro Electric Scheme. Given that ownership had been transferred from the Minister for Industry and Commerce many years ago and no files were still on hands in my Department there was considerable delay in resolving this issue.

All such property, acquired by the Minister for Industry and Commerce, is now vested in the Minister for Transport, Energy and Communications under the relevant Transfer of Departmental Administration and Ministerial Functions Orders. Accordingly, I have arranged to have the relevant correspondence passed to that Department.
