61 Mr. Killeen asked the Tánaiste and Minister for Foreign Affairs when undertakings given to the family of a deceased person (details supplied) in County Galway regarding access to British Home Office documents will be honoured; and if he will make a statement on the matter. [18105/95]

As I stated in reply to a question from Deputy Ó Cuív on 17 October 1995, I told the family that I would take up with the Home Office any points identified by the family's legal advisers as requiring explanation or clarification. I understand that the family are waiting for a decision by the British Legal Aid Board about a possible change of solicitors looking at the case.

In April 1995 the family requested that the Home Office be asked for a copy of the book of evidence in the murder trial. Their solicitor subsequently took up the matter with the Lord Chancellor's Department and was informed that the relevant papers cannot be traced and that they may have been destroyed in error.
