Question:

81 Mr. E. O'Keeffe asked the Minister for Finance the reason a company (details supplied) in County Cork was not approved for participation in a tax incentive scheme; and if his attention has been drawn to the large number of investors who are annoyed and aggrieved that approval was not forthcoming; and if he will make a statement on the matter. [4928/96]

I have been advised by the Revenue Commissioners that the company was not approved for participation in the business expansion scheme as it was not considered to be carrying on qualifying trading operations within the meaning of the scheme. The decision to refuse approval was subsequently upheld on appeal by the Appeal Commissioners. I understand that the company is now seeking to have the case re-heard by the Circuit Court.
