Written Answers. - Disqualification Order Application.

Question:

72 Miss Harney asked the Minister for Agriculture, Food and Forestry the reason he has not taken steps under the provisions of the Companies Act, 1990, to apply to the High Court for an order of disqualification from holding any position as a company director or manager, of the directors and senior management of the Goodman Group of companies, in view of the policies and activities of that group of companies as outlined in the beef tribunal report; and if he will now take steps to do so. [4910/96]

I refer the Deputy to my response on 12 March 1996 to a similar question from Deputy O'Malley. It has not been legally established that I am a creditor of the particular company. I am legally advised that a judgment in court would be necessary to establish that I am a creditor. In the absence of such a judgment, I could not make application to the High Court for an order of disqualification.
