Question:

152 Mr. Finucane asked the Minister for Justice when registration for adverse possession will be dealt with by the Land Registry in respect of a person (details supplied) in County Limerick; and if she will make a statement on the matter. [9863/96]

I am informed by the Registrar of Titles that this dealing refers to an application under section 49, i.e. acquisition of title by virtue of long possession of the Registration of Title Act, 1964, which was lodged on 22 March 1995. I understand that due to their complicated nature, applications under section 49, which require detailed examination of the applicants claim for registration as owner, take time to process.

I am also informed that to date a number of queries have been issued to the applicant's solicitor and that a reply is awaited to the latest queries which issued on 19 March 1996. The matter cannot proceed until the queries issued are satisfactorily discharged.
