Written Answers. - Appeals Against Lenient Sentences.

Question:

40 Mr. Molloy asked the Minister for Justice the number of cases where the State has appealed the leniency of a sentence since the introduction of the relevant legislation; the outcome of each appeal; and if she will make a statement on the matter. [9779/96]

I understand from the Office of the Director of Public Prosecutions that the director has caused notice of appeal against unduly lenient sentences to be lodged in three cases. In one case, the appeal was unsuccessful, in the second, a date for hearing is awaited and, in the third, a decision was made to withdraw notice of appeal.
