326 Mr. Molloy asked the Minister for the Marine the reason his Department has sought the payment of foreshore licences for only some of the developments that have taken place at the foreshore at Valentia Harbour, County Kerry; the circumstances, if any, under which certain developers are exempted from paying foreshore licences; and if he will make a statement on the matter. All occupiers of State foreshore are required to first apply for and get a Foreshore Licence or Lease. All leases and licences under the Foreshores Acts are subject to fee payments. The allegations raised in the letter referred to by the Deputy in Question No. 175 on 15 May 1996 are being looked into.

A permit was issued under the Fisheries (Consolidation) Act, 1956, to facilitate trials. There is no charge raised for this type of permit.

Such permits are not permanent permissions and the application for longterm licences under the Foreshore and Fisheries Acts must await the outcome of technical and scientific assessment and ultimately the Minister's decision on licensing in this case.
