Question:

55 Kathleen Lynch asked the Minister for Tourism and Trade the plans, if any, he has to review the operation of the Control of Exports Act, 1983 and the dual-use regulations to ensure that licences and end-user certificates are required for all components which could be used in the assembly of instruments of future and similar implements. I assume the Deputy's question refers to instruments of torture.

The EU Regulation and Council Decision of 19 December 1994, which introduced a new EU-wide system for the control of exports of dual-use goods, do not explicitly control the export of the type of equipment referred to in the question.

I intend to include specialised security and paramilitary equipment among the items subject to our national export control system in the orders I will be making arising from the introduction of the EU Dual-Use Regulation. An application for an export licence for equipment of this nature would only be considered following the presentation of a satisfactory end-use certificate.
