Question:

48 Mrs. Geoghegan-Quinn asked the Minister for Health his current policy regarding smoking in health board hospitals; and if he will make a statement on the matter. [12025/96]

Under the Tobacco (Health Promotion and Protection) Regulations, 1995, smoking is prohibited in all hospitals except that specific facilities may be provided for staff and patients to smoke. The implementation of this prohibition is in the first instance the responsibility of the hospital management. Any person in breach of the prohibition, or any management which fails to take reasonable steps to prevent breaches of it, would be liable to prosecution.
