76 Ms Shortall asked the Minister for the Environment the by-laws or regulations, if any, there are regarding the erection and location of satellite dishes; if his attention has been drawn to the unsightliness of such dishes on the fronts of houses; the plans, if any, he has to introduce new legislation in respect of these dishes; and if he will make a statement on the matter. In accordance with Class 4 of Part I of the Second Schedule to the Local Government (Planning and Development) Regulations, 1994, the erection on, or within the curtilage of, a dwellinghouse of a satellite television signal receiving antenna is exempted development for the purposes of the Planning Acts, subject to certain conditions. These conditions include, inter alia, that no such antenna shall be erected on, or forward of, the front wall, or on the front roof slope of a house or higher than the highest part of the roof.

Where the erection of a satellite antenna is not exempted development, for example where an antenna is to be erected on the front wall of a house, an application must be made for planning permission.
