163 Mr. Killeen asked the Minister for the Marine the nature of the relationship between the Commissioners of Irish Lights and his Department regarding the Loran C radio-navigation system; whether commissions or fees are being charged; and if so, the way in which they are computed. [12969/96]

164 Mr. Killeen asked the Minister for the Marine the amount that has been spent by his Department to date in respect of solicitors fees in relation to court proceedings relating to the Loran C project; and whether the matter has been referred to the Taxing Master of the High Court. [12970/96]

165 Mr. Killeen asked the Minister for the Marine the amount that his Department has spent on fees to junior and senior counsel arising from court proceedings relating to the Loran C project; and whether the question of fees has been referred to the Taxing Master of the High Court. [12971/96]

I propose to take Questions Nos. 163 to 165, inclusive, together.

The Commissioners of Irish Lights are acting on an agency basis on behalf of the Department of the Marine in respect of the Loran C project and are paid a management charge in this regard. The commissioners calculate this charge on the basis of percentages of the salaries of a number of their staff who are involved in work relating to the project.

To date no moneys have been paid in respect of fees to solicitors or junior and senior counsel in relation to Loran C court proceedings. These fees have not been referred to the taxing master. However, legal fees in respect of an earlier planning appeal were submitted to the taxing master who allowed senior counsel and the solicitors their full fees. While the Chief State Solicitor's office has accepted the taxing master's decision in respect of the solicitor's fees, senior counsels' fees are the subject of a Supreme Court appeal.
