262 Éamon Ó Cuív asked the Minister for Justice whether the British Government has requested that any special undertaking be given by the Irish Government prior to agreeing to the transfer of prisoners (details supplied); if so, the nature of these conditions; and if she will make a statement on the matter. I propose to answer Questions Nos. 261 and 262 together.

The United Kingdom authorities have not requested that any special undertaking be given by the Irish Government in relation to requests from prisoners in the UK seeking transfers here under the Convention on the Transfer of Sentenced Persons. The usual information sought under the Transfer of Sentenced Persons Act, 1995 in relation to nationality, offence and details of the manner in which it is proposed to administer the balance of the sentences in question has been supplied to the UK authorities.

The requests for a transfer to a prison in this country from the persons referred to in the questions were returned to the Home Office earlier this year with my formal consent for a transfer to take place in each case. It is now a matter for the UK Home Secretary to consider the question of giving his consent to the transfers and for the individuals concerned to also give their formal consent.
