Written Answers. - Implications of Supreme Court Judgment.

Question:

53 Mr. Dempsey asked the Minister for the Environment the implications, if any, for local government of the judgment of the Supreme Court in the case Shannon Regional Fisheries Board versus Cavan County Council. [16365/96]

The judgment in this case underlines the need for planning authorities to have regard to the adequacy of existing or planned sewerage infrastructure in preparing and adopting their development plans and in exercising their planning control functions.

My Department has issued a circular to local authorities drawing attention to the relevance of the judgment in the context of their planning and environmental functions. The circular draws attention also to the provisions of the Local Government (Planning and Development) Act, 1990, which give local authorities additional powers of control over access to public sewerage infrastructure.
